According to New York State Penal Law, sparkling devices are permitted for use by individuals aged 18 and over. Sparking devices are ones that produce a colored flame or shower of colored sparks, whistling noise or audible crackling and smoke. The devices must be hand held or mounted on a spike or base and can only contain 1 to 500 grams of pyrotechnic composition.
