Putnam Sheriff's Official Loses Bid To Stay Mum In Levy Case

PUTNAM COUNTY, N.Y. -- A Putnam County sheriff’s official will have to submit to questioning next month about what he told the FBI about Adam Levy, according to the former district attorney’s lawyer, Michael Sussman.

Last week lohud.com reported that a state Supreme Court judge had, in June, ordered sheriff’s Capt. William McNamara to make a pre-trial sworn statement about what he may have told federal authorities about the ex-prosecutor’s connections to his former live-in trainer, Alexandru Hossu.

Levy is suing Putnam County Sheriff Donald Smith and others, claiming that they smeared his reputation by saying he had interfered with a criminal case involving Hossu, lohud.com reported.

Levy recused his office from prosecuting the case and Hossu, a Romania immigrant who had been accused of sexually assaulting an adolescent, was acquitted in 2014, according to media reports and Sussman.

Ever since, Levy has been trying to obtain information that may have been given to two federal agencies, the lohud.com story said.

Sussman said Tuesday that McNamara’s lawyer, Lewis R. Silverman of White Plains, renewed the argument late last week that his client shouldn’t be forced to testify.

Lohud.com reported that Silverman said his client felt it was improper to talk about something that might involve an ongoing investigation by another law enforcement agency.

The judge, however, ordered the deposition to proceed and McNamara is set to testify on Wednesday, Sept. 7, Sussman said.

Silverman could not be reached for comment Tuesday.

Levy ran for re-election last year, but lost. He is the son of Judith Sheindlin, television's "Judge Judy."
