Driver Sentenced In Ossining Lawyer’s Death

OSSINING, N.Y. – Michelle Sergio, 39, of Nanuet was sentenced for crimes that led to the death of Ossining attorney John Mangialardi. She is to serve an undetermined term of one to three years in prison.

Sergio pleaded guilty in May 2014.

Sergio was charged with two counts of vehicular manslaughter in the second degree (class D felonies) and two counts of driving while intoxicated (class A misdemeanors).

The accident had occurred at about 10:15 p.m. Sept. 3, when Sergio, who said she was on the way to an Ossining social service agency, when she struck Mangialardi as he crossed Route 9A, at the intersection of Route 134, said Westchester County District Attorney Janet DiFiore. He was pronounced dead at the scene by EMTs who responded to the accident.

Sergio’s blood alcohol level was at 0.12 at the time, the DA said. Police reconstructed the accident and arrested Sergio.

The prosecutor in the case was Assistant District Attorney Timothy Ward, chief of the Career Criminal Bureau.
