As you may or may not be aware, there are two new laws that are being proposed by our Town Supervisor that will affect every homeowner and every renter in Putnam Valley by requiring a new code for all properties being sold and/or improvements to their property. These onerous laws can only be passed by a majority vote of the five Town Board Members.
Two of which claim they will vote no, Councilwoman Jackie Annabi and Councilmen Steve Mackay. I made a suggestion to Sam Oliverio to put this out to vote to the residents via a referendum. He responded "he would bring my suggestion to the town council but he will not alter procedural law or legal requirements upon the request of 1 individual who demands change."
Here are the two proposed laws: Article XVII : Seller of any real property must obtain an updated Certificate of Occupancy before a property can be sold, the property must comply with current building codes and ordinances, and there will be no grandfather exclusions. This must be done within 60 days of closing. Rental Law Chapter 165-36H: All rental property (an apartment, a room or entire home) must apply for a permit, the permit process will include an inspection by code enforcement and the property must meet current building code and ordinances. There is a list of requirements and stipulation included in this permit process including inspections to safeguard the health, safety, MORALS and welfare of the public. For property owners who deny access to inspection, code enforcement will file an application for a search warrant. If you are concerned about your private property rights and have an opinion on these two laws, you must attend the public hearing at town hall at 6 p.m. on March 9, 2016.
